Welcome to Inner Silence Yoga. By accessing our website, booking a class, or using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our services. If you do not agree with any part of these terms, you must refrain from using our website or services. These terms and conditions apply to all visitors, users, and others who access the website and/or purchase our services. These terms govern your use of our website and services, including online and in-person yoga classes, courses, and events.
ELIGIBILITY

By using this website and our services, you confirm that you are:

  • At least 18 years old, or have parental/guardian consent if under 18.
  • Physically and mentally capable of participating in yoga classes, understanding the potential risks involved.
  • Not misusing, damaging, or interfering with the website or its content in any way.
CLASSES AND SERVICES

We offer yoga, meditation and yogic counseling classes, both online and in-person, tailored to help improve wellness. By booking or attending a class:

  • You confirm that you are physically and mentally able to participate in yoga practice and understand the risks involved.
  • You agree to follow all safety instructions given during the classes and assume full responsibility for any injuries or damage resulting from your participation.
  • It is your responsibility to inform us of any health conditions or injuries prior to class participation.
PAYMENTS AND REFUND POLICY

Payments for bookings are due at the time of registration. Payments for classes, courses, and services must be made through our secure payment system or manual invoicing.

All purchases are final. However, refunds or rescheduling may be offered at our discretion for cancellations made 24 hours prior to scheduled classes or for proven technical issues related to online classes.

In the event of a service cancellation by Inner Silence Yoga, you may be eligible for a full refund or rescheduling at no extra charge, at the discretion of Inner silence Yoga.

In case of a failed payment or chargeback, we reserve the right to cancel your booking or refuse future services.

MEMBERSHIPS AND SUBSCRIPTIONS
Memberships, where applicable, are non-refundable and non-transferable, unless specified otherwise. You can cancel a membership anytime. Cancellations will apply to future billings, and no refunds will be provided for the current period. Email cancellation details to info@innersilenceyoga.com.au
TERMINATION

We reserve the right to terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including but not limited to a violation of these Terms.

Upon termination, certain clauses of these Terms will continue to remain in effect, which should not be affected by termination. This includes, but is not limited to, provisions related to ownership rights, disclaimers of warranties, indemnity, and limitations on liability.

Additionally, we may terminate or suspend your account at our discretion, immediately and without notice, if you breach these Terms.

Once your account is terminated, your right to access and use the service will cease immediately. If you choose to terminate your account, you can simply stop using our services.

INTELLECTUAL PROPERTY

All content provided on this website, including but not limited to logos, text, images, videos, and other materials, is the property of Inner Silence Yoga or its licensors and is protected by Australian intellectual property laws. 

You may not reproduce, distribute, or commercially exploit any content from our website or classes without our written consent.

RECORDING POLICY

Participant Rights: Participants are not permitted to record classes or distribute class recordings without prior written consent from Inner Silence Yoga. This ensures the privacy of all participants and protects intellectual property.

Instructor Rights: Inner Silence Yoga may record classes for quality improvement, training, or on-demand services. Recordings will only be used with participant consent and will not include identifiable personal information unless explicitly agreed upon.
Privacy Assurance: Any recorded material will be securely stored and used exclusively for the intended purposes outlined in this policy.

Violation of Policy: Unauthorized recording or distribution of classes may result in termination of the membership and potential legal action to protect privacy and intellectual property.

LIMITATION OF LIABILITY

We aim to provide accurate information and quality services, but we make no warranties or guarantees about the accuracy or completeness of the website content or class outcomes or the content meeting your specific needs.

Inner Silence Yoga is not liable for any loss or injury resulting from your reliance on information from the website or participation in any classes or services.

To the maximum extent permitted by law, we exclude all liability for any direct, indirect, or consequential damages arising from the use of our services or website including but not limited to injury, loss of data, or system failures.

HEALTH DISCLAIMER

By participating in any yoga class or event, you acknowledge that yoga involves physical activity and may result in injury. You are responsible for ensuring that you are physically and mentally fit to participate and that you notify the instructor of any health conditions, injuries, or medical concerns.

Always consult a healthcare professional before starting any exercise program, especially if you have pre-existing conditions or are pregnant.

Inner Silence Yoga and its instructors are not responsible for injuries or health issues arising from your participation in online and in-person yoga classes, courses, and events. 

GOVERNING LAW

These terms are controlled by Australian law, regardless of any conflicting legal principles.

If we don’t enforce any part of these terms, it doesn’t mean we are giving up our right to do so later. If a court finds any part of these terms invalid or unenforceable, the rest will still apply. 

These terms represent the entire agreement between us regarding the service, and they replace any previous agreements we may have had.

Our website may contain links to third-party websites. These links are provided for your convenience only, and we do not endorse or assume responsibility for the content or privacy practices of those websites.
CHANGES TO TERMS
We reserve the right to update or modify these terms at any time, at our sole discretion. Any changes will be posted on this page with an updated effective date. Your continued use of the website after any changes constitute acceptance of the new terms and if you do not agree with the new terms, you should stop using the service. If we make significant changes, we will aim to give you at least 30 days notice before the new terms take effect. What qualifies as a significant change will be decided by us alone.
COMMUNICATION AND NOTIFICATIONS

By enrolling in a plan with Inner Silence Yoga, participants agree to receive communications, including promotional materials, event updates, schedule changes, and notifications related to classes or services, via email or phone. Participants can opt out of promotional communications at any time by contacting us at info@innersilenceyoga.com.au.

PLAN SPECIFIC TERMS AND CONDITIONS

a)  Monthly Plan – 3 Classes-per-Week (Single and Dual Participant plans)

 Plan(s) Details:

  • Duration: 1 Month 
  • 20% off for the first month for new participants
  • Up to 12 online classes per month, 3 per week: Mon-Wed-Fri or Tue-Thu-Sat
  • Monthly recurring billing cycle
  • No Lock-In Contracts
  • 30-min Complimentary Initial Consultation for new participants
  • Eligibility for Dual Participant plan: any two individuals sharing the same screen – spouses, siblings, friends, etc.

b)  4-Week Plan – 2 Classes-per-Week (Single and Dual Participant plans)

 Plan(s) Details:

  • Duration: 4 weeks 
  • 20% off for the first month for new participants
  • Up to 8 online classes per 4 weeks (2 classes per week)
  • Recurring 4 weekly billing cycle
  • No Lock-In Contracts
  • 30-min Complimentary Initial Consultation for new participants
  • Eligibility for Dual Participant plan: any two individuals sharing the same screen – spouses, siblings, friends, etc.
General Policies
  • All classes, memberships, and packages are non-refundable and non-transferable. 
  • Participants are encouraged to attend up to 3 classes weekly to maximize the benefits of the monthly plan (and 2 classes weekly for the 4 week plan)
  • Unused classes do not carry over to the next week or month. 
  • Class packages are for individual use only and cannot be shared (applies to single participant plan) 
  • Substituting participants with a guest or an unregistered individual is prohibited without prior onboarding and approval from Inner Silence Yoga.
  • Complimentary initial consultation is available to all new participants to discuss health goals, limitations, and progress plans.
  • The 2-Participant Plan is designed for two individuals (spouses, siblings, friends, etc.) sharing one screen. Both participants must adhere to plan policies.
Number of classes:

a) Monthly Plan – 3 Classes-per-Week:

  • Includes up to 3 classes per week. Classes reset weekly and are not cumulative from week to week
  • A minimum of 12 classes per month, with up to 13 classes in months with extra days (depending on the calendar).
  • In months with 5 weeks, participants may have an extra week of 3 classes. This is a complimentary addition to the 12 classes normally offered.

b) 4-week plan – 2 Classes-per-week:

  • Up to 8 online classes over 4 weeks (2 classes per week)
Make-Up Classes (applicable to Single participant plans)
  • If a class is missed, 1 make-up class per billing period is permissible, to accommodate circumstances and provide flexibility
  • Make-up classes must be used within the same calendar billing period. 
  • If a make-up class cannot be scheduled within the billing period (e.g., close to month-end, membership suspension), it can be used in the first week of the next billing period, subject to availability.
  • Make-up classes cannot be carried forward beyond the allowed period or exchanged for monetary value.

Additional Note: Make-up classes are designed to accommodate genuine missed sessions due to unforeseen circumstances. Repeated misuse or intentional absences aimed at gaining extra sessions may result in limitations or suspension of make-up class privileges.

Make-up classes (applicable to 2-participant plans)
  • The account is collectively allowed 1 make-up class per billing period, regardless of whether one or both participants miss classes on the same or separate days. This is designed to accommodate unforeseen circumstances and provide flexibility.

  • Eligibility: Only the participant who missed the class is eligible to attend the make-up class. If the other participant (who did not miss any class) wishes to join the make-up class, they will be charged the single participant class rate.

  • Both Participants Miss Classes: If both participants have missed a class each in the same billing period, 1 make-up class can be organized for both the participants to attend together without any additional cost.

  • Solo Attendance: If one participant cannot attend the make-up class, the other may attend the class solo. However, this will count as the account’s sole make-up class for the billing period.

  • Same Screen Policy: The make-up class must be attended by both participants together using the same screen. Make-up classes cannot be split into separate sessions.

  • Timing: Make-up classes must be used within the same calendar billing period. If a make-up class cannot be scheduled within the billing period (e.g., close to month-end, membership suspension), it can be used in the first week of the following billing period, subject to availability.

  • Non-Transferable: Make-up classes cannot be carried forward beyond the allowed period or exchanged for monetary value.

Additional Note: Make-up classes are designed to accommodate genuine missed sessions due to unforeseen circumstances. Repeated misuse or intentional absences aimed at gaining extra sessions may result in limitations or suspension of make-up class privileges.

Membership suspension (applicable to Single participant plans)
  • Memberships can be paused for a minimum of 1 week and a maximum of 4 weeks per suspension. For pregnancy, the suspension period can extend up to 1 year.  

  • Members are allowed 4 suspensions per year (from the date of sign-up). 

  • At least 2 weeks’ notice is required for suspension requests via email at info@innersilenceyoga.com.au. 

  • Missed classes during suspension will roll over to the next billing period as make-up classes, and billing will be adjusted accordingly.  

  • Suspension or make-up class calculations are based on the remaining classes in the billing period, not those already attended

Additional Note: Suspensions are intended to accommodate genuine needs, such as travel, health issues, or unforeseen circumstances. Repeated misuse or abuse of this policy may lead to suspension privileges being limited or revoked.

Membership suspension (applicable to 2-participant plans)
  • Memberships can be paused for a minimum of 1 week and a maximum of 4 weeks per
    suspension.
  • Suspensions for pregnancy can extend up to 1 year for one or both
    participants.
  • The account is collectively allowed up to 4 suspensions per
    year
    (from the date of sign-up), regardless of whether the suspension is
    requested for one or both participants.
  • At least 2 weeks’ notice is
    required for suspension requests. Requests must be sent via email to
    info@innersilenceyoga.com.au.
  • If only one participant
    wishes to suspend their membership while the other continues to attend, the account remains active.
  • When one participant is on suspension, the other participant must advise if they
    want to continue solo or suspend.
  • The participant who continues attending will be charged the single participant
    plan rate during the suspension period. 
  • The suspended participant’s missed classes will roll over as make-up
    classes
    for use upon resuming membership.
  • Any missed classes by the non-suspended participant will count toward the account’s collective 1 make-up class allowance per billing
    period.
    • 1 Active Participant:
      The billing period cost is adjusted as per single participant plan
    • No Active Participants:
      No charges during full suspension of the account.
      Billing will
      be adjusted based on the active participant(s) during the suspension period:
  • Suspension periods are non-transferable between participants and must be used as
    per the account’s policy.
  • Suspension or make-up class calculations are based on the remaining classes in
    the billing period, not those already attended

Additional Note: Suspensions are intended to accommodate genuine needs, such as
travel, health issues, or unforeseen circumstances. Repeated misuse or abuse of this policy may lead to suspension
privileges being limited or revoked. 

Time slot selection and changes
  • Participants can select their preferred time slot during onboarding.

  • Changes to the selected time slot are permitted, subject to availability.

  • To request a temporary time slot change, email info@innersilenceyoga.com.au with a 48 hours notice

  • To request a  permanent time slot change, fill out the Time Slot Change Request Form  with a 2 weeks’ notice.

Pro-rated policy for mid-billing period starters
  • Participants starting the classes mid-billing period will be billed based on the remaining classes in the billing period.  

  • For example : Monthly plan – 3 classes per week (Single participant)

    Cost per class is $15  

    Starting on December 20th with 4 classes left in the month would cost:  

        4 classes x  $15/class  = $60 for December

Billing
  • Payments are billed once per billing period either via manual invoicing or through a secure third party company via auto-debit.  

  • For monthly plans: Billing occurs monthly, regardless of whether the month has 28, 29, 30, or 31 days.

  • Manual Invoicing: Payments must be made in advance for the next billing period’s classes and paid within 14 days of the invoice.

  • Auto Debit: Automatic Payments are deducted in advance. Failed auto-debit payments may incur an administration fee.

  • Billing will continue until a cancellation notice is provided by the participant or the participant is refused service by Inner Silence Yoga.

Cancellation Policy
  • Cancel anytime with 2 weeks’ email advice before the next payment date.  

  • Email cancellations to: info@innersilenceyoga.com.au.  

  • Unused make-up classes are forfeited upon cancellation. 

  • If one participant chooses to cancel the account and service, the remaining participant will continue on the single participant plan (specific to 2-Participants plan).

  • Both participants must individually submit a cancellation notice via email to cancel the account and service (specific to 2-Participants plan).
